III. Content and Construction of - Outer Burial Container Price Lists

  1. Introductory Matters

    As with the Casket Price List, there are three items which must appear at the top of the Outer Burial Container Price List:

    1. Name of Funeral Home -The name of the funeral home must be printed at the top of the Outer Burial Container Price List; the address and phone number of the funeral home is not necessary.

    2. "Outer Burial Container Price List" - The list should be identified as the "Outer Burial Container Price List." It is technically a violation of the Rule to label the Outer Burial Container Price List a "Vault Price List."

    3. Effective Date - The effective date of the Outer Burial Container Price List must be stated at the top of the price list.

  1. Outer Burial Container Listings

    All containers which the funeral director regularly offers should be listed on the Outer Burial Container Price List. Containers that need to be specially ordered are not required to appear on the list. If a funeral home does not offer outer burial containers to its customers, there is no requirement that it prepare an Outer Burial Container Price List.

    A brief description of the exterior of the outer burial container should be provided on the price list. Manufacturers, model names and model numbers need not be listed. In addition, the containers may be listed in any particular order that the funeral director prefers.

    1. Alternative Formats

      As with the Casket Price List, funeral directors may use brochures, notebooks and charts in lieu of a printed or typewritten Outer Burial Container Price List.

  • Disclosure—Legal Requirements

    The language of the mandatory disclosure which must appear on the Outer Burial Container Price List has been modified by the amended Funeral Rule. That disclosure must now read as follows: "In most areas of the country, state or local law does not require that you buy a container to surround the casket in the grave. However, many cemeteries require that you have such a container so that the grave will not sink in. Either a grave liner or a burial vault will satisfy these requirements." This disclosure may be placed anywhere on the Outer Burial Container Price List. In addition, the first six words of the disclosure ("In most areas of the country,") may be eliminated at the option of the funeral home if the funeral home operates in an area where state and local law does not require the use of an outer burial container.
